Contract Review Terms and Conditions

Free Residential Contract Review Terms & Conditions

Thank you for requesting a complimentary Contract Review from North Shore Conveyancing Pty Ltd ("North Shore Conveyancing", "we", "our" or "us").  By submitting a contract through our website, you acknowledge that you have read, understood and agree to these Terms & Conditions.

1. Purpose of the Contract Review

Our complimentary Contract Review is designed to help prospective buyers better understand the terms of a residential Offer & Acceptance before signing. The review is intended to identify provisions that may require clarification or further consideration and to assist you in making a more informed decision.  It is an educational service designed to explain your contract in plain English and highlight potential issues before you become legally bound.

2. Eligibility

 

The complimentary Contract Review is available for residential property transactions in Western Australia.  Eligible contracts include:

  • Residential Offer & Acceptance contracts

  • Off-the-plan residential purchase contracts

 

The service does not currently extend to:

  • Commercial property

  • Industrial property

  • Rural property

  • Auction contracts

  • Leasing documentation

  • Development agreements

  • Options or other specialised property contracts

 

We reserve the right to decline any review that falls outside the scope of this service.

 

3. Scope of the Review

Our review is limited to the contract and documents you provide.  As part of the review we may:

  • Explain contractual clauses;

  • Identify provisions that may require clarification;

  • Explain settlement timeframes;

  • Discuss finance and inspection conditions;

  • Identify unusual or uncommon contractual provisions;

  • Answer general questions relating to the contract.

 

The review is based solely on the documents submitted.

 

4. What the Review Does Not Include

The Contract Review does not include:

  • Title searches;

  • Planning investigations;

  • Zoning enquiries;

  • Strata record inspections;

  • Building or pest inspections;

  • Engineering advice;

  • Valuation advice;

  • Taxation advice;

  • Accounting advice;

  • Financial advice;

  • Mortgage advice;

  • Legal advice .

 

We do not investigate matters that are not evident from the documents supplied.

5. No Property Due Diligence

A Contract Review is not a substitute for undertaking your own due diligence.  You remain responsible for satisfying yourself regarding matters including (without limitation):

  • The physical condition of the property;

  • Building compliance and council approvals;

  • Planning and/or zoning matters;

  • Easements;

  • Restrictive covenants;

  • Environmental matters;

  • Finance approval;

  • Insurance;

  • Investment suitability.

 

6. No Guarantee

 

The Contract Review is intended to assist you in understanding your contract.  We cannot guarantee:

  • That the contract is suitable for your circumstances;

  • That no issues will arise during settlement;

  • That your offer will be accepted;

  • That your finance will be approved;

  • That future events will not affect your transaction.

 

7. No Appointment to Act

Submitting a contract for review does not appoint North Shore Conveyancing to act on your settlement.  If your offer is accepted and you wish us to act, a separate Appointment to Act and Cost Disclosure will be provided.

8. Turnaround Time

We aim to complete reviews within two (2) business days of receiving all required documentation.  While we make every effort to meet this timeframe, delays may occasionally occur during periods of high demand or where additional information is required.  If your contract has an urgent signing deadline, please indicate this when submitting your request. Although we cannot guarantee priority processing, we will make reasonable efforts to accommodate urgent matters where possible.

9. Fair Use Policy

Our complimentary Contract Review service is intended for genuine residential buyers actively seeking to purchase property.  There is no fixed limit on the number of contracts we will review for a client.  However, we reserve the right to decline further reviews where we reasonably believe the service is being used excessively, for commercial purposes, or otherwise inconsistently with the intended purpose of the service.

10. Information You Provide

You warrant that:

  • The information you submit is accurate;

  • You are authorised to provide the documents uploaded;

  • The documents have not been altered or modified;

  • You have obtained any necessary permissions to provide personal information relating to third parties.

 

11. Privacy

Any personal information you provide will be collected, stored and used in accordance with our Privacy Policy.  By submitting your contract, you consent to us collecting and using your personal information for the purpose of completing the Contract Review and communicating with you regarding your enquiry.

12. Intellectual Property

The Contract Review, including any written comments, recommendations, emails or explanatory material prepared by North Shore Conveyancing, remains our intellectual property.  It is provided solely for your personal use in connection with your proposed property purchase.  It must not be copied, reproduced, distributed or relied upon by third parties without our prior written consent.

13. Limitation of Liability

The Contract Review is intended to assist you in better understanding your contract and identifying matters that may warrant further consideration.  It should not be relied upon as a substitute for independent legal, financial, taxation, engineering or other specialist advice where such advice is appropriate.  To the maximum extent permitted by law, North Shore Conveyancing excludes all liability for any loss, damage, cost or expense arising from reliance on the Contract Review or any information provided as part of that review.  Nothing in these Terms excludes any rights that cannot lawfully be excluded under the Australian Consumer Law.

14. Changes to these Terms

We may amend these Terms & Conditions from time to time.  The current version published on our website will apply at the time you submit your Contract Review request.

15. Governing Law

These Terms & Conditions are governed by the laws of Western Australia.  Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Western Australia.
